Our Perspective:

Many citizens are upset that they were never told by their water utility, health care provider, patient advocacy organization, trade groups, or government entities about possible harm from ingested fluorides. Many citizens may well need financial assistance to pay for care for fluoride-caused or fluoride-exacerbated conditions. Some will be interested in compensation to help them pay for teeth repair.

We believe there are a number of possible legal avenues that will be pursued over time. We are not attorneys (so this is not legal advice), but it seems logical to us that individuals and groups may wish to pursue cases for failure to warn, negligent misrepresentation, medical malpractice, consumer fraud, informed consent, and even civil rights and environmental justice cases (since minorities are disproportionately harmed by fluorides and fluoridation). If you or your child were given fluoride supplements (drops or pills), we think you may find it useful to consider if your health provider first questioned you sufficiently about the other sources of fluoride in your or your child’s life. Assessing total fluoride intake is in accordance with guidelines established by the American Dental Association and other professional groups. The 1994 Dietary Fluoride Supplement Schedule approved by ADA and other groups says that a complete fluoride history, including ALL of your child’s sources of fluoride should be taken by the provider.

Did the provider of the supplements before prescribing them first obtain from you detailed information about fluorides from juices, baby foods, solid foods, water and other beverages of all kinds, whether toothpaste was swallowed, how much water was consumed, the level of fluoride in the water, etc? The U.S. Dept. of Agriculture has a list of fluoride content in many foods and beverages if you would like to review it. All of these considerations may be useful if you believe legal action may be needed or desired on behalf of yourself or your child.
